> The English version prevails for interpretation. This is an official translation of the English-language version of these Terms, and its content is identical to that version. This translation has the same legal effect as the English version. In the event of any discrepancy, the English version prevails. Nothing in this clause affects any mandatory right you have under the law of your country of residence, including your right to bring proceedings before your local consumer authority or to use a recognised alternative dispute resolution mechanism.

1. Agreement and operator

These Terms of Service ("Terms") govern your use of the website at redsugartree.com (the "Site"). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

The Site is operated by Gu Shan (trading as "RedSugarTree"). The operator is an individual (natural person), not a company or a registered business. Contact: [email protected], No. 39 Yanjiang Avenue, Xintang Town, Zengcheng District, Guangzhou, Guangdong 511340, CHINA.

2. This site does not sell anything

This Site does not sell any product or service. No orders, payments, subscriptions, or purchases of any kind can be made here. The Site does not accept payment for any purpose.

Nothing on the Site constitutes an offer to sell, a contract of sale, an invitation to treat that may be accepted, or a commitment to deliver any product or service at any time. Requesting project updates creates no obligation on either side: it only means you ask us to email you about the project, and it means we may email you about it.

3. SoloDesk is a project in development, and is not available

SoloDesk is a software project that is still under development. It is not finished, it is not distributed, and it is not available to use, download, subscribe to, or buy. Any description on the Site of what the project is intended to do describes intended direction and work in progress, not a finished, available, or delivered product. Any statement that might suggest otherwise is an error, and this Section 3 controls.

If a version of SoloDesk is ever released, it will be made available through a separate website dedicated to it, and the terms applicable to it will be published on that website. Nothing on this Site commits us to that, or to its timing, scope, or form, and this Site does not describe or preview any commercial terms.

4. The Site

The Site is an informational project site that charges nothing. We may change, suspend, or discontinue any part of it at any time without notice. We may also change the project update subscription, the features it offers, and how it works.

5. Acceptable use

You agree not to: use the Site unlawfully; attempt to gain unauthorised access to the Site or its infrastructure; interfere with or disrupt the Site; scrape or harvest the Site at a rate that degrades it for others; submit false, misleading, or infringing content; impersonate others; or use the Site to send unsolicited commercial communications.

6. Our content and intellectual property

The Site, including its design, layout, text, graphics, logos, illustrations, code, and the name "RedSugarTree" and the name "SoloDesk", and all associated intellectual property rights in them, belong to Gu Shan or its licensors. We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Site for your own personal or internal business use. Nothing else is granted.

You may quote short extracts from the Site for commentary or review, with clear attribution and a link back. You may not reproduce substantial parts of the Site, or use our marks, logos, or project names in your own branding or domain name, without prior written permission.

7. Third-party content and links

The Site may reference or link to third-party websites, products, or services. We do not control them and we are not responsible for their content, accuracy, availability, security, or privacy practices. Links are provided for convenience. A link does not imply endorsement, and we accept no responsibility for the content of any linked site.

8. No warranty

The Site and all content on it are provided "as is" and "as available", without warranty of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or completeness. We do not warrant that the Site will be available, uninterrupted, secure, or error-free, or that any content will be complete or current. Project information on the Site describes intended direction and work in progress, and may differ substantially from anything eventually released.

To the fullest extent permitted by law, we disclaim all implied warranties, including without limitation merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.

9. Limitation of liability

To the fullest extent permitted by law, we and our licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunity, arising out of or in connection with your use of, or inability to use, the Site, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with the Site and these Terms shall not exceed USD 100.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that applicable consumer law (including, where applicable, the EU Unfair Contract Terms Directive and the EU Consumer Rights Directive, and the equivalent legislation of your country of residence) does not permit us to exclude or limit. If you are a consumer, the limitation in this Section applies only to the extent that it does not deprive you of the benefit of any mandatory statutory protection, and where a mandatory statutory right is broader than the limitation above, the statutory right prevails.

10. Intellectual property claims

If you believe that content on the Site infringes your intellectual property rights, contact us at [email protected] with: identification of the work, identification of the material claimed to infringe, your contact details, a statement that you have a good-faith belief the use is not authorised, and your signature. We will review and respond as required by applicable law.

11. Disclaimer of liability for content accuracy

We do not warrant that any information about the SoloDesk project published on the Site is complete or final. The pre-release material is a statement of intent.

12. Governing law and jurisdiction

These Terms are governed by the laws of the People's Republic of China, without regard to its conflict-of-law rules.

The courts of the People's Republic of China have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, except that if you are a consumer, you retain the benefit of any mandatory provision of the consumer protection law of your country of habitual residence, and nothing in this Section limits the right to bring proceedings in the courts of your country of habitual residence or in the courts of your place of residence where you live. Where you are a consumer in the European Union, you may bring proceedings in the member state in which you live.

Nothing in this Section limits any right you have to bring proceedings before a consumer arbitration body or to use a recognised online dispute resolution platform in your country of residence.

13. Changes to these Terms

We may amend these Terms from time to time. The version in effect is the one published on this page at the time you use the Site. We will post the updated version with a new "Last updated" date and, where a change is material, will notify subscribers by email before it takes effect. Continued use of the Site after the change constitutes acceptance of the amended Terms.

14. Severability

If any provision is held invalid or unenforceable, the remainder continues in effect.

15. Entire agreement

These Terms, together with our Privacy Policy and Legal Notice (both published on the Site), are the entire agreement between us regarding the Site.
